Mahindra Foundation is a Delaware not-for-profit corporation having a registered address at 1000 West Street, 17th floor, The Brandywine Building, Wilmington, New Castle County, Delaware – 19801 (“Mahindra Foundation” or “we” or “our”). Mahindra Foundation is committed to protecting the privacy and security of your personal data. Your privacy is important to us.

This Privacy Policy (the “Policy”) provides you with information on how we will process your personal data as (i) a (potential) donor; and (ii) a user of our website, specifically https://mahindrafoundationusa.org/ (hereinafter the “Website”). However, Mahindra Foundation collects certain personally identifiable information about you when you choose to submit such information to us through an online form, email, or other method (the “personal data”). This Policy does not apply to personal data collected by us offline or through any other means or any third party, including our affiliates and subsidiaries, including through any application or content (including advertising) that may link to or be accessible from or on the Website.

Website visitors: In the course of your visit to this Website, we will automatically collect the following information:

Donors: We collect personal data in the course of your donation to Nanhi Kali from you directly (name, email address, mailing address, company name, contact details).

There is no obligation to provide the data that we ask you for. However, if you do not provide your personal data, you will not be able to make use of all the functions of this Website or donate.

We share your personal data with our affiliates and subsidiaries for the purpose of providing the services you have agreed to with respect to the Website. We may also share your personal data with third parties, to the extent necessary to provide a service you have requested, or to appropriately respond to an enquiry you have submitted. Additionally, Mahindra may use your personal data if (1) disclosure was required by law, rule or regulation or was in response to a valid order of a court or authorized agency of government or other legal process and/or; (2) When we find your action on the Website violates Mahindra terms and conditions or any of your usage guidelines for specific products or services.  

While any application, request or enquiry you make may be forwarded or made available to Mahindra Foundation and other Mahindra Foundation Affiliates some of which will be based in countries that do not have data protection laws, Mahindra Foundation and all other Mahindra Foundation Affiliates are required to comply with an internal Privacy Policy which requires that steps are taken to protect your personal data and for it to only be used for the purpose(s) for which it was submitted. 

By submitting your personal data and information through the Website, you are explicitly consenting to it being processed in the manner described above by us.

We do not control third parties’ collection or use of your personal data to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your personal data collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website. 

Although we take full precautions to protect your personal data & maintain a high level of security, the Website could be subject to a cyber-attack/crime, which may result in loss of your private data. In such cases, any data loss will be treated as accidental, and you will be notified in a manner as required by applicable law.

  1. Accessing and Correcting Your Personal Data

You can review and change your personal data by logging into the Website and visiting your account profile page.

We cannot delete your personal data except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Our Website is not intended for children under 16 years of age. No one under age 16 may provide any personal data to or on the Website. We do not knowingly collect personal data from children under 16. If you are under 16 years of age, do not use or provide any personal data on this Website or through any of its features, or register on the Website. If we learn we have collected or received personal data from a child under 16 without verification of parental consent, we will delete that data. Notwithstanding the foregoing, since use of the Website is intended for the education of underprivileged girls from classes 6 to 10, the personal data reflected on the Website may pertain to girls within this age group. To the extent you use this information for donation purposes, you agree to use this information solely to understand how your donations are being utilized, and not for any other purpose. Further, even though photographs of such children are also updated on the Website, you agree that you are not authorized to use such photographs without our prior written approval.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of their personal data to third parties for their direct marketing purposes. The California Online Privacy Protection Act requires us to disclose how we will handle your browser’s Do Not Track setting. At this time, we are unable to sync with such settings to ensure Do Not Track requests are honoured.

We have implemented measures designed to secure your personal data from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide us with us stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website, like message boards.
